Welcome to Doctor Paw! These Terms and Conditions ("Terms") govern your use of our website and services related to emotional support animals (ESAs). By accessing or using our website, you agree to comply with these Terms. Please read them carefully.
1. Services Provided
Doctor Paw offers services related to obtaining an ESA letter, which may include consultations with licensed mental health professionals, assessments, and the issuance of ESA letters. The ESA letter is intended to certify that the client has a legitimate need for an emotional support animal as part of their mental health treatment.
2. Eligibility
To use our services, you must be at least 18 years old or have reached the age of majority in your jurisdiction, whichever is older. By using our services, you confirm that you meet this requirement.
3. User Account
To access certain services, you may need to create an account. You agree to provide accurate and complete information and to update your information as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4. Privacy Policy
Your use of our services is also governed by our Privacy Policy, which outlines how we collect, use, and protect your personal information. By using our services, you consent to our data practices as described in the Privacy Policy.
5. ESA Letter Services
Consultation:
Our services include a consultation with a licensed mental health professional. This consultation will determine your eligibility for an ESA letter based on your mental health condition.
Issuance of ESA Letter: If eligible, you will receive an ESA letter from a licensed mental health professional. The letter will include all necessary information to certify your need for an emotional support animal.
6. Money-Back Guarantee
We offer a money-back guarantee if your ESA letter is not accepted by your landlord. To qualify for this guarantee, you must:
Provide proof of the landlord's rejection of the ESA letter within 30 days of receiving the letter.
Allow Doctor Paw to contact the landlord or property manager to address the rejection.
Follow any additional steps recommended by Doctor Paw to resolve the issue.
If the issue cannot be resolved and the ESA letter is not accepted, we will provide a full refund of the purchase price of the ESA letter.
7. Refunds and Cancellations
Refunds are subject to the terms of the Money-Back Guarantee. Cancellations must be requested before the consultation with a licensed mental health professional begins. Once the consultation has taken place, no cancellations or refunds will be provided, except as outlined in the Money-Back Guarantee.
8. Limitation of Liability
Doctor Paw and its affiliates, officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, data loss, or other intangible losses, resulting from your use of our services.
9. Disclaimer
Our services are provided on an "as is" and "as available" basis. We do not warrant that the services will be uninterrupted, error-free, or secure. We disclaim all warranties, express or implied, including any warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Indemnification
You agree to indemnify and hold Doctor Paw, its affiliates, officers, employees, agents, and licensors harmless from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of our services.
11. Arbitration Agreement and Class Action Waiver Agreement to Arbitrate Disputes
By using this website and purchasing our subscription services, you agree that any disputes arising out of or related to these Terms and Conditions, including but not limited to claims related to your subscription or use of our services, will be resolved exclusively through final and binding arbitration, rather than in court, except as provided below.
Class Action Waiver
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You hereby waive any right to a trial by jury or to participate as a plaintiff or class member in any purported class or representative proceeding.
Arbitration Procedures
The arbitration will be administered by [Arbitration Administrator, e.g., the American Arbitration Association (AAA)] under its Consumer Arbitration Rules. The arbitrator will have the exclusive authority to resolve any disputes, including disputes related to the interpretation, applicability, enforceability, or formation of this Arbitration Agreement.
Exceptions to Arbitration
You and [Your Company Name] retain the right to seek remedies in small claims court for individual disputes or to seek injunctive relief in a court of competent jurisdiction for certain claims, such as for breach or threatened breach of intellectual property rights.
Opt-Out Option
You have the right to opt out of this Arbitration Agreement by sending a written notice of your decision to opt out to [Company’s Contact Address] within 30 days of your initial purchase.
Costs of Arbitration
Each party shall be responsible for its own arbitration fees and expenses, except as otherwise provided by the rules of the chosen arbitration administrator or as required by applicable law.
12. Changes to Terms
We may update these Terms from time to time. Any changes will be posted on this page with an updated effective date. Your continued use of our services after such changes constitutes your acceptance of the new Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Doctor Paw operates, without regard to its conflict of law principles.
